General terms and conditions of business

Applicability of the Terms and Conditions

The following Terms and Conditions of deutschkurseonline.com serve as the basis for the conclusion of all contracts concerning the services/products offered on the website www.deutschkurseonline.com. The website is directed at companies as well as private and commercial users (hereinafter referred to as “users”). These Terms and Conditions apply to both parties.

The individual provisions of our Terms and Conditions apply to consumers and businesses within the meaning of §310 of the German Civil Code (BGB), depending on their content. Provisions explicitly designated as applicable only to businesses do not apply to consumers. Consumers within the meaning of these Terms and Conditions are natural persons who enter into a business relationship with deutschkurseonline without the activity being attributable to a commercial or self-employed professional capacity. Users' own terms and conditions shall only apply if deutschkurseonline has explicitly agreed to them in writing.

Conclusion of Contract

Registration/order for a particular service or product is made by the contracting party through completion and submission of the booking form. By doing so, the user submits a legally binding offer to purchase the requested service/product. deutschkurseonline accepts this offer by sending a confirmation email. The contract between deutschkurseonline and the user is formed upon receipt of this confirmation email.

Any scheduling commitments made by deutschkurseonline are subject to the availability of suitable teaching staff. deutschkurseonline will make every effort to provide a substitute teacher in the event of absence. However, there is no entitlement to tuition by a specific teacher. For cancelled lessons (UE), simulations or programmes caused by deutschkurseonline, alternative lessons or programmes will be offered. If this is not possible in an individual case, deutschkurseonline commits to promptly notifying the user and refunding any fees paid for undelivered UE at the end of the programme. deutschkurseonline does not guarantee any specific learning or instructional outcomes. Recommendations regarding required UEs to achieve learning goals are based on years of experience and may differ in individual cases.

Right of Withdrawal / Cancellation Policy

Users may revoke their contractual declaration in text form (e.g., letter, email) within 14 days without stating a reason. The withdrawal period begins upon conclusion of the contract. Sending the withdrawal notice before the deadline is sufficient to meet the deadline. If the user has already started the course or the first UE has taken place, the right of withdrawal no longer applies, and the full course fee becomes due.

For the delivery of products/learning materials, the withdrawal period does not begin until the day the user receives them. Regardless of the right of withdrawal, services already utilised must be paid for.

Course bookings are for a pre-defined period or number of hours in the case of private and corporate courses. There is no entitlement to a refund or replacement lessons for missed appointments or interruptions.

Pricing

The prices valid at the time of order apply to all services/products. All prices include VAT.

Payment Terms

The applicable prices are listed in the service/product description on www.deutschkurseonline.de. By registering or ordering, the user agrees to pay these fees. Payment is due upon registration/order.

Lesson fees must be paid no later than three days before the first UE/simulation begins. Any paid learning materials are due for payment immediately upon receipt. Customers will receive a separate invoice.

Payments received will be applied to the oldest outstanding invoice unless otherwise specified. If the contract remains dormant (i.e., no UEs/simulations attended) for more than three months, deutschkurseonline reserves the right to adjust prices in case of a change in tariff. The user will be notified of such changes.

Terms for Language Lessons

Lesson Structure:
One teaching unit (UE) consists of 45 minutes. A simulation consists of 60 minutes.

Cancellations:
The user must notify the deutschkurseonline administration of any inability to attend a scheduled UE/simulation no later than 14:00 on the previous day. For Monday sessions, notification must be given by 14:00 on the preceding Friday. Failure to provide timely notice will result in full charges for the missed UE/simulation.

Contracts may be terminated with five working days' notice. Upon termination, the user is entitled to a refund for any paid but unused UEs/simulations that would have occurred after the notice period.

Individual Lessons / Individual Lesson Packages:
Contracts may be cancelled up to three working days before the first UE/simulation. Later cancellations are not permitted. Refunds for unused but paid UEs/simulations are not available unless the contract was cancelled on time.

Group Lessons:
deutschkurseonline reserves the right to reassign users to another group for pedagogical reasons, if this supports better learning progress. Cancellations up to two weeks before the start of the course are free of charge. Later cancellations before the first UE will incur a cancellation fee of 20% of the course fee. Cancellations made five days before the start of the course will incur a 70% charge.

For courses already in progress: if the user cannot attend (e.g., due to illness, holidays, or work obligations), the fee remains payable. Immediate termination by either party is only possible for good cause. deutschkurseonline is also entitled to terminate the contract without notice if the user is in default of payment. All cancellations must be made in writing.

If the user continues to attend UEs after the agreed course duration has ended, this will be deemed an extension of the contract under the currently applicable terms and conditions.

Refund Claims

Unused but paid UEs/simulations expire 12 months after the last attended UE/simulation. Separate written agreements between the user and deutschkurseonline may be made. Refunds after the statutory limitation period of three years are excluded. Refunds for purchased and received learning materials are also excluded.

Copyright

All teaching materials provided by deutschkurseonline are protected by copyright and may not be copied, used commercially, or distributed—even in part—without prior written consent.

Data Protection

User data is used by deutschkurseonline for internal processing and promotional purposes, in accordance with applicable data protection regulations. For more details, please refer to the privacy policy on www.deutschkurseonline.de.

Liability and Warranty

deutschkurseonline accepts no liability for the availability or accessibility of www.deutschkurseonline.de.
deutschkurseonline is not liable for any specific learning or seminar outcomes. It also accepts no liability for the cancellation of seminar modules due to force majeure. Liability arising from mandatory legal provisions remains unaffected.

Jurisdiction

The statutory place of jurisdiction applies.

Final Provisions

For EU member states (excluding the United Kingdom and Denmark), the Rome I Regulation applies. This regulation determines which national legal system is applicable. It has universal effect, meaning the rules apply regardless of whether the applicable law is that of an EU member state or a third country. Under Rome I, the default rule is that the law of the country providing the characteristic performance applies.

Amendments and additions to the contract must be made in writing. Should any provision of these Terms and Conditions prove invalid, deutschkurseonline is entitled to replace it with a valid provision of similar intent. If this is not possible, the statutory provisions shall apply.
